General Terms and Conditions of Transport

At Vycab Transfert, we are dedicated to providing a reliable and seamless transfer experience. Whenever a passenger transport is booked with Vycab, the following terms and conditions apply to the services provided by the responsible carrier (referred to as the "PROVIDER" or "PROVIDERS") to the passenger (referred to as the "USER" or "USERS"). These terms govern the contract between the PROVIDER and USER for transport services.

Article 1: Special Booking Details
To ensure smooth service, the USER must provide essential booking details, as follows:
Accurate Information: The booking must include the correct flight number, pick-up and drop-off addresses, date and time, and a contact number where the passenger can be reached.
Passenger and Luggage Information:
Number of passengers
Number of luggage items
Any bulky items (e.g., skiing or golf equipment)
Specific requirements for children’s seating
Luggage Size: Standard checked bags are generally up to 120 cm when adding length + width + height.
Child Safety: Children under 12 years or 150 cm must be secured in an approved child seat according to traffic regulations. Users traveling with infants must provide a baby car seat of Group 0 or 0+, as required by Taxi Fare Regulations.
Child Seat Availability: Child seats are available upon request for an additional charge of 10 Euros per seat and are suitable for children weighing between 9 kg and 36 kg. Vycab provides child seats based on the above information, ensuring passenger safety in compliance with regulations.

All bookings must be made at least 24 hours prior to the scheduled pick-up time and date for transfers or tours. If you require a transfer within 24 hours, please contact our office at +230-5790-3040 during working hours (7:00 AM to 5:00 PM). If you need a transfer before the 24 hours, you may pay an extra service charge.

Article 2: Transport Procedure
Attendance: The USER is required to be at the agreed location and time after receiving the booking confirmation.
Identification: The USER shall identify themselves using booking details as requested by the driver and authorize payment by signature or by providing their Vycab PIN, if applicable.
Booking Changes: Any changes to booking details (such as time, location, or contact information) must be communicated to Vycab at least 24 hours before the pick-up. Last-minute changes may incur additional fees.
Flight Monitoring: Vycab monitors flights via Flightradar24 to ensure accurate timing. Upon flight landing, a 45-minute buffer is provided for a smooth transition and pick-up.
Substitute Arrangements: If force majeure prevents the PROVIDER from completing the trip, a substitute driver and vehicle may be arranged. The USER will be notified of any changes.

Article 3: Prices, Fees, and Terms of Payment
Private Hire Services: For private hire, the PROVIDER agrees to the price listed on Vycab, including all fees (e.g., parking, tolls, and waiting time).
Additional Costs: The fixed price excludes USER-induced costs from route changes, extra waiting times, or additional services. Changes made after specified time limits may incur additional fees.

Article 4: Changes to Transport Contracts and Related Consequences

Article 4.1: Cancellations and Rescheduling by USERS
Private Hire Services: Cancellations or rescheduling for private hire must be made at least 24 hours before the pick-up. After this period, cancellations are non-refundable.
Rescheduled Bookings: Rescheduled bookings, or booking detail change may result in a recalculated fare and reassignment of the PROVIDER, subject to availability.
Travel Delays: If delayed by a plane, coach, or train, no extra charges apply. The USER must inform the PROVIDER of any delays.

Article 4.2: Late Arrival and Non-Attendance of USER
Contact: The USER should contact the driver if they expect to be delayed.
Waiting Fees: Waiting time and non-attendance fees will apply as per taxi fare regulations.
Vycab Services: If the USER does not arrive without prior cancellation, the full fare may be charged.

Article 4.3: Exceptional Situations
Private Hire Services: Cancellations or rescheduling for private hire must be made at least 24 hours before the pick-up. After this period, cancellations are non-refundable.
Rescheduled Bookings: Rescheduled bookings may result in a recalculated fare and reassignment of the PROVIDER, subject to availability.

Article 5: Liability
Limited Liability: Except for liability under the Product Liability Act (Loi sur la responsabilité du fait des produits) and liability for injury to life, limb, or health, the PROVIDER’s liability is limited as follows:
In cases of negligence, liability is limited to foreseeable damages. For minor negligence, liability applies only if a duty essential to the contract's performance has been breached, particularly regarding the use of the booking platform.
Representatives: These liability limitations also apply to the PROVIDER’s representatives and agents if claims are made against them directly.

Article 6: Legal Validity of Other Language Versions
This document is governed by the laws of Mauritius and is provided in both French and English. In case of discrepancies, the French version shall prevail.

Newsletter
Our newsletter keeps you informed about our company and services. To receive it, simply provide a valid email address.

Registration Process
We use a double opt-in process for registration. After you sign up, we'll send a confirmation email to the address provided. You’ll need to confirm your subscription within 24 hours.
If you don’t confirm, your information will be temporarily stored and automatically deleted after one month.
Additionally, we record your IP address and the time of registration and confirmation. This process helps verify your consent and protects against any potential misuse of your data.

Required Information
The only information required to receive the newsletter is your email address. Once you confirm, we securely store it solely for the purpose of sending you our newsletter, in compliance with Art. 6 para. 1 sentence 1 lit. a) GDPR.

Newsletter Distribution
Our newsletters are sent using Brevo-SENDINBLUE, located at 7 Rue de Madrid, 75008 Paris, France, as per Art. 6 Par. 1 S. 1 lit. f) GDPR. If you subscribe, your email address will be securely transmitted to SENDINBLUE servers in France, where it will remain until you decide to unsubscribe, as detailed in Section 4.4.

Data Protection Compliance
In compliance with the Commission Implementing Decision (EU) 2016/1250 of July 12, 2016, data transfers from EU controllers to organizations in France adhere to the principles of the EU-US Privacy Shield. You can read more about Brevo’s data protection practices here: Brevo Privacy Policy.

Unsubscribing
You can unsubscribe from the newsletter at any time by clicking the unsubscribe link at the bottom of each email. Alternatively, you may unsubscribe by sending a request to the email address listed in our website’s imprint (https://vycabtransfer.com) or Section 1.2.
Upon unsubscribing, any personal data stored for the newsletter will be deleted unless a legal retention requirement applies.

What We Are Not Responsible For Tours and Transfer Service

Personal Injury or Accidents
Visitors who book a tour participate at their own risk. We are not liable for injuries, falls, uneven terrain, reckless behavior, or unauthorized exploration at any of the haunted locations. Please exercise caution at all times.

Lost or Stolen Items
Keep your belongings secure at all times. We are not responsible for lost, stolen, or misplaced personal items during the tour or any transfer service. If any item is left in our vehicles, a service charge will apply for retrieval. Please contact us immediately for assistance.

Paranormal Disturbances
While we embrace the supernatural and the eerie history of each location, we cannot be held responsible for any unexplained occurrences, spiritual encounters, or paranormal disturbances during or after the tour.

Emotional or Psychological Distress
Tours includes dark history, ghost stories, and potentially unsettling locations. If at any point you feel overwhelmed, uneasy, or frightened, it is your choice to continue or leave the tour. We encourage all participants to assess their comfort levels before booking.

Changes in Tour Accessibility
Some locations may become temporarily inaccessible due to maintenance, weather conditions, or government regulations. While we strive to maintain our itinerary, we reserve the right to adjust or replace stops when necessary.

Personal Choices & Experiences
We are not responsible for individual decisions made during the tour, including venturing into restricted areas, engaging in reckless behavior, or failing to follow safety instructions.

Booking Changes & Cancellation Policy

If you book an Airport Transfer, Tour, Local Transfer, Driver for Activities, or tours. You may request changes to certain booking details, including the pickup or drop-off address, pickup time, vehicle capacity, flight number, or vehicle class (please note that changes to vehicle class may affect the price). Any changes or cancellations must be made at least 24 hours before the scheduled start time of the booking. Requests made within 24 hours of the scheduled start time may not be accommodated and may incur additional charges. We reserve the right to decline changes to booking details once the booking has been confirmed.

Bookings & Payment
All bookings must be made through our official website or office. Direct bookings with drivers are not allowed and will result in automatic cancellation without notice. Payment must be made online only. No cash payments are accepted under any circumstances.

Cancellations & Refunds
Cancellations are free of charge with a full refund if made at least 24 hours before the scheduled tour or transfer. No refunds will be provided for cancellations made less than 24 hours in advance or for no-shows.

Pricing
The quoted price covers transportation only. Entrance fees, meals, activities, and personal expenses are not included unless specifically stated.

Waiting Time

For airport pick-up transfers, the driver will wait at Gate 6 inside the airport holding a sign with your name. We monitor flight numbers for delays and will wait up to 60 minutes after your flight lands. Additional waiting time is charged at €1 per minute beyond 60 minutes.

For non-airport transfers, the driver will wait up to 30 minutes at the provided pickup address. Additional waiting time is charged at €1 per minute beyond the included period.

If we are unable to reach you after several attempts, the service will be considered provided, and the full booking amount will apply.

Tour Duration
Time starts at pickup. Extra time is charged at €20 per additional hour, subject to driver availability.

Child Seats
Child seats are available for €10 each and must be requested at the time of booking. If requested less than 24 hours before pickup, availability is not guaranteed and an additional €10 charge per seat will apply.

Luggage
The maximum guaranteed luggage size per item is 63 cm height, 36 cm width, and 21 cm depth. Larger items may not fit in the booked vehicle, and a larger vehicle may be required at additional cost plus a service fee.

Cleaning & Vehicle Use
A minimum €200 cleaning fee applies for excessive mess (vomiting, sand, spills, stains). Additional charges apply for specialized cleaning or damage repairs. Guests are fully responsible for any additional costs resulting from willful damage or neglect. Eating, drinking, or smoking is not permitted in the vehicle, except for medical reasons.

Weather & Safety
Service is not provided during Class 3 or higher cyclones. Refunds will be issued if rescheduling is not possible due to weather conditions.

Itinerary Changes
Any itinerary changes must be approved by our office. Additional charges may apply.

Accurate Information
Please provide complete and accurate booking details at checkout, including date, time, pickup and drop-off addresses, flight number (if applicable), number of passengers, luggage details, and contact information. We cannot guarantee service if details are missing or incorrect, and no refund will be provided in such cases.
